If a person is gay and says he's a muslim, who are we to say he has gone out of Islam by believing that being gay is permitted in islam?

As long he believes in the shahadah and That the prophet s.a.w is the prophet of God...then that should be enough for us, the rest is between him and God and not for us to judge.

When a sahabi (this story would have more weight if i knew the guy's name) was sent to rule Yemen, the prphet s.a.w asked him how was he going to rule, the reply was something like: With the text of the Quran, then the tradition of the prophet, then by using my mind.

So that basically shows that even back then, they expected differences according to region, ie we cannot follow Saudi law in Australia.
